Data Processing Agreement (DPA)

This Data Processing Agreement ("DPA") forms part of the Terms of Service between trackerrtg.com (the "Processor") and the User (the "Controller").

1. Definitions

• "Data Protection Laws" means all applicable privacy and data protection laws including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
• "Personal Data" means any information relating to an identified or identifiable natural person that is processed by trackerrtg.com on behalf of the Controller.

2. Scope and Role

This DPA applies when Personal Data is processed by trackerrtg.com as a Processor on behalf of the User. The subject matter of the processing is the provision of traffic tracking analytics. The duration of the processing shall be for the term of the service agreement.

3. Processor Obligations

The Processor agrees to:

• Process Personal Data only on documented instructions from the Controller.
• Ensure that persons authorized to process the personal data have committed themselves to confidentiality.
• Implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption and pseudonymization where applicable.
• Assist the Controller in responding to requests from data subjects exercising their rights (e.g., right to access or delete data).

4. Sub-processing

The Controller provides a general authorization for the Processor to engage third-party sub-processors (such as cloud hosting providers or payment gateways). The Processor shall remain fully liable to the Controller for the performance of that sub-processor's obligations.

5. Data Transfers

If the Processor transfers Personal Data originated in the European Economic Area to a country outside the EEA, it shall ensure that such transfers are subject to appropriate safeguards, such as Standard Contractual Clauses (SCCs).

6. Audit Rights

The Processor shall make available to the Controller all information necessary to demonstrate compliance with the obligations laid down in Article 28 of the GDPR and allow for and contribute to audits, including inspections, conducted by the Controller or another auditor mandated by the Controller.
